Terms of Service

Meson’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Meson can use such data in accordance with our privacy policies.

When permitted by law, we, and our suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.

To the extent permitted by law, the total liability of Meson Computers, and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the services (or, if we choose, to supplying you the services again).

In all cases, we and all our suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.

Meson may change the price for the Paid Services from time to time, and will communicate any price changes to you. Price changes for Paid Services will take effect at the start of the next subscription period following the date of the price change. By continuing to use the Meson Service after the price change takes effect, you accept the new price.

These Terms will continue to apply to you until terminated by either you or Meson. Meson may terminate the Terms or suspend your access to the Meson Service at any time, including in the event of your actual or suspected unauthorized use of the Meson Service or non-compliance with the Terms. If you or Meson terminate the Terms, or if Meson suspends your access to the Meson Service, you agree that Meson shall have no liability or responsibility to you and Meson will not refund any amounts that you have already paid, to the fullest extent permitted under applicable law. We endeavor to provide the best service we can, but you understand and agree that THE MESON SERVICE IS PROVIDED “AS IS”, WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. YOU USE THE MESON SERVICE AT YOUR OWN RISK. MESON DISCLAIMS ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. In addition, Meson does not warrant, endorse, guarantee or assume responsibility for any Third Party Applications, Third Party Application content, User Content, or any other product or service advertised or offered by a third party on or through the Meson Service or any hyperlinked website, or featured in any banner or other advertising. You understand and agree that Meson is not responsible or liable for any transaction between you and third-party providers of Third Party Applications or products or services advertised on or through the Meson Service. As with any purchase of a product or service through any medium or in any environment, you should use your judgment and exercise caution where appropriate. No advice or information whether oral or in writing obtained by you from Meson shall create any warranty on behalf of Meson in this regard. Some aspects of this section may not apply in some jurisdictions.

You agree that, to the extent permitted by applicable law, your sole and exclusive remedy for any problems or dissatisfaction with the Meson Service, the Third Party Applications or the Third Party Application content is to uninstall any Meson software and to stop using the Meson Service, the Third Party Applications or the Third Party Application content.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MESON, ITS OFFICERS, SHAREHOLDERS, EMPLOYEES, AGENTS, DIRECTORS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, ASSIGNS, SUPPLIERS OR LICENSORS BE LIABLE FOR (i) ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL (INCLUDING LOSS OF USE, DATA, BUSINESS, OR PROFITS) DAMAGES, ARISING OUT OF THE USE OR INABILITY TO USE THE MESON SERVICE, THIRD PARTY APPLICATIONS OR THIRD PARTY APPLICATION CONTENT, REGARDLESS OF LEGAL THEORY, WITHOUT REGARD TO WHETHER MESON HAS BEEN WARNED OF THE POSSIBILITY OF THOSE DAMAGES, AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE; (ii) AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE MESON SERVICE, THIRD PARTY APPLICATIONS OR THIRD PARTY APPLICATION CONTENT MORE THAN THE AMOUNTS PAID BY YOU TO MESON DURING THE PRIOR THREE MONTHS IN QUESTION.

Nothing in these Agreements removes or limits Meson’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by its negligence. Some aspects of this section may not apply in some jurisdictions.

We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a Service, you should discontinue your use of that Service.

If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.

These terms control the relationship between Meson and you. They do not create any third party beneficiary rights.

If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).

If it turns out that a particular term is not enforceable, this will not affect any other terms.

These Agreements are subject to the laws of Pakistan, without regard to choice or conflicts of law principles. Further, you and Meson agree to the exclusive jurisdiction of the courts of Pakistan to resolve any dispute, claim or controversy that arises in connection with these Agreements.

YOU AND MESON AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A CLASS MEMBER OR IN ANY REPRESENTATIVE CAPACITY OR PROCEEDING. Further, no arbitrator shall consolidate any other person’s claims with your claims, and may not otherwise preside over any form of a multi-party or class proceeding. If this specific provision is found to be unenforceable in any way, then the entirety of this arbitration section shall be null and void. The arbitrator may not award declaratory or injunctive relief.

Any arbitration must be commenced by filing a demand for arbitration with the courts within ONE (1) YEAR after the date the party asserting the claim first knows or reasonably should know of the act, omission or default giving rise to the claim; and there shall be no right to any remedy for any claim not asserted within that time period. If applicable law prohibits a one-year limitations period for asserting claims, any claim must be asserted within the shortest time period permitted by applicable law. Your arbitration fees and your share of arbitrator compensation will be limited to those fees set forth in the Arbitration Act with the remainder paid by Meson. Any arbitration costs or fees deemed “excessive” will be paid by Meson.
